Jonathon H. Bloomberg
Mr.
Bloomberg focuses on environmental regulatory issues, advising clients on air
and water compliance, emissions release reporting, OSHA compliance, land use,
wetland regulation, and government environmental review of new projects.
Mr. Bloomberg
has represented clients regionally and nationally in air and water permit
negotiations with state and federal regulators.
He has provided air and water compliance advice to a wide range of
clients and has represented clients in the successful resolution of alleged
regulatory violations and potential citizen-suit litigation. Mr. Bloomberg familiarizes himself with client
operations by conducting facility walk-throughs.
This enables him to work closely with clients to design novel compliance
strategies and to structure nationwide compliance programs.
In
particular, Mr. Bloomberg has been heavily involved in the preparation of
the first Final Project Agreement in Minnesota under the Environmental
Protection Agency's Project XL Program and finalization of the permit
implementing that Agreement. The
permit contains flexible and innovative methods for tracking and permitting air
emissions at a facility designed to ease regulatory burdens and delays.
Mr. Bloomberg
also has assisted many clients with OSHA compliance, implementing worker
protection programs and representing companies in OSHA enforcement actions. He has drafted environmental assessment worksheets for
facility expansion and has assisted in identifying and addressing potential
environmental issues related to proposed projects, including issues relating to
wetland preservation and other land-use regulations.
His litigation practice focuses on administrative law, constitutional
issues, environmental review, and Environmental Rights Act cases.
Most
recently, Mr. Bloomberg was on the negotiating team that finalized a
multi-facility settlement under EPA's nationwide New Source Review enforcement
initiative.
Mr. Bloomberg
received his Bachelor of Science degree, cum laude, from the University
of Minnesota. He received his Juris
Doctor degree, magna cum laude (Order of the Coif), from Cornell
University Law School. He was an
editor of the Cornell Law Review.
Mr. Bloomberg
is a member of the American Bar Association, Administrative Law and Natural
Resources Law sections; and the Minnesota State Bar Association, Administrative
Law, Environmental and Natural Resources sections.
